July 10, 2017

Marshall Gerstein and 12 of its partners have been recognized in the IAM Patent 1000: The World’s Leading Patent Professionals 2017. This year’s honorees include:

The firm is recommended for the following practice areas:

  • IP Litigation
  • Prosecution
  • Transactions

With multiple individuals recommended in each area of patent practice, Marshall Gerstein “is alert and attentive to clients’ every conceivable prosecution need and has a broad technical bench that sets it apart not only locally, but also nationwide” according to the IAM Patent 1000 guide. The guide further highlights the Firm’s “unrivalled sense of continuity” such that “Marshall Gerstein is not a place where people come and go quickly – this makes it reliable and very effective at building long-term relationships with clients.” The Firm’s “capabilities in the transactional space” are “similarly impressive” compared to IP Litigation and Patent Prosecution practices recognized.

IP Litigation
Partner and IP Litigation chair Benjamin Horton “focuses his efforts on high-technology lawsuits and is an adroit performer before district courts and the PTAB.” Partners Kevin Flowers, Ph.D. and John Labbé “filed the fourth ever biosimilar case under the Biologics Price Competition and Innovation Act” and are “teaming up with Mark Izraelewicz on another biosimilar case.”

Patent Prosecution

The guide describes the Firm as having “one of the best biotechnology and life sciences groups in the business, led by “brilliant strategic lawyer” Heather Kissling.” [Ms. Kissling] “has fostered a collaborative ethos, with partners Jeffrey Sharp, Katherine Neville, Ph.D. and Michael Muczynski” by “constantly riffing off one another to present clients with the best possible options.” Managing Partner Jeff Sharp “is not just a very accomplished attorney; he works cooperatively and won’t argue over trivial things, which is refreshing. You can really take him at his word.” Partner Katherine Neville, Ph.D. is seen as a “deft global portfolio manager” and “a repository of trust for big pharma, start-ups and non-profits alike.” Mr. Muczynski “helms the chemical sciences section with a sure hand.” The guide further notes “the inspiring leadership of individuals such as Kissling, Muczynski and prosecution chief Jeremy Kriegel” as “instrumental” in sustaining relationships with clients. [Mr. Kriegel] “hails from a mechanical engineering background, as does Michael Furmanek.” The two partners “carry the Firm’s name effectively outside the life sciences domain in diverse sectors such as automotive and clean energy.”

IP Transactions

Partner and IP Transactions chair, Pamela Cox “stands out as a leading transactional light” with “simplifying daunting, almost cost-prohibitive approaches to market for clients and staying the course in protracted negotiations.” In addition, Ms. Cox possesses the “ability to forcefully protect your rights while quickly and nimbly resolving the most complex issues in negotiations.” Ms. Cox “does a wonderful job translating lessons learned into a better practice structure.” Robert Gerstein is noted to be “passionate about finding and executing integrated solutions” as well as “another lodestar for companies looking to seal deals.”
