“NPEs—The Special Issues Arising from Disputes with NPEs”

Julianne M. Hartzell, partner and chair of Marshall, Gerstein & Borun’s medical devices practice, participated as a panelist during Practising Law Institute (PLI)'s Patent Litigation Program 2016. The program took place on October 13-14, 2016, at the University of Chicago Gleacher Center in Chicago, IL.

Ms. Hartzell participated in “NPEs—The Special Issues Arising from Disputes with NPEs” at 10:00 a.m. on October 14, 2016. The panel provided perspectives on litigating on behalf of, or against, non-practicing entities (NPEs) that are asserting patent rights. Plaintiff’s counsel offered perspectives on representing litigants that may or may not have deep pockets, as well as effective strategies when the opponent is the larger, more entrenched entity, including ways to manage multi-party litigation and discovery. Defense counsel shared tips on evolving legal and practical strategies to mitigate the impact of abusive tactics by some NPEs, including early resolution/disposition techniques, smart motion practice, and effective use of joint defense groups.
