Paul C. Craane discusses Bilski v. Kappos in the context of the patent-eligibility of carbon credit trading methods in “Patenting Carbon Credit Trading: Dodging Certainty,” appearing in the September issue of Biomass Magazine. While Bilski is likely to leave the patent community uncertain where the lines are drawn on patent-eligible vs. patent-ineligible business methods, it did not do away with business methods with the certainty a near-majority of the Supreme Court would have liked. In this regard, Mr. Craane responds, “a little uncertainty might just be a good thing for those patenting carbon credit trading methods.”
