Anthony Whittington
Associate

Anthony Whittington is an associate with Marshall, Gerstein & Borun where he is involved in all areas of patent law including drafting and prosecuting patent applications in the electrical, software and mechanical arts as well as all aspects of patent litigation.  Mr. Whittington has also drafted opinions on patentability, infringement and validity.

Prior to joining the firm, Mr. Whittington was an associate with DLA Piper U.S. LLP in the Washington, D.C. office.  He was a member of the patent litigation practice group.  In addition to his patent prosecution experience, Mr. Whittington also gained extensive litigation experience that included discovery requests and responses, witness preparation and defense for depositions, drafting claims charts on infringement and inequitable conduct.  He assisted in a trial before the International Trade Commission.  Mr. Whittington also has conducted due diligence transactions for various patent portfolios involving joint ventures between U.S. companies and international companies.

Mr. Whittington was an associate and summer associate at Sughrue Mion PLLC in Washington, D.C.  At this firm, he also prosecuted biomedical, electrical, software, and optics applications, drafted responses to office actions, drafted patent applications, and conducted interviews with examiners. 

While visiting away at Georgetown Law Center, Mr. Whittington was a patent agent with Shook, Hardy & Bacon LLP in the Washington, D.C. office.  While at this firm, he drafted and prosecuted a variety of patent applications in many technical areas and conducted telephonic and in-person interviews with examiners. 

Mr. Whittington was also a Patent Examiner for the U.S. Patent and Trademark Office.  He conducted technical and legal research to determine the patentability of error detection and corrections devices in telecommunication and digital systems in such classes as 714/699+ and 365/201.  He examined applications related to PCT applications, non-provisional applications, national stage applications (371) and continuation applications (CPAs and RCEs).  His areas of technological expertise included digital logic testing-boundary scan, pattern generators, BIST Error correction/detection-CRC bits, Hamming codes, trellis diagrams, semiconductor test systems-memory testing, analog systems and software applications. 

Mr. Whittington received his J.D. from Washington University School of Law in 2006.  He received the Scholar in Law Award.

Mr. Whittington completed his B.S. in Electrical Engineering on an accelerated track of three years.  He was a Pollack Family Scholar and made Dean’s List.
