As courts continue to define the boundaries of trademark protection following the U.S. Supreme Court’s Jack Daniel’s decision, Marshall Gerstein Partner and Chair of the firm’s Trademarks & Copyrights Practice, Tiffany Gehrke, shared her perspective with Law360 on how that landmark ruling is influencing one of the year’s most closely watched trademark disputes. 

In its roundup of the most significant trademark decisions of 2026 to date, Law360 highlighted the ongoing Disney “Lots-o’-Huggin’ Bear” litigation as an important example of how courts are applying Jack Daniel’s in practice. 

Discussing the case, Tiffany told Law360, “I’d be curious if the court does do a new order on reconsideration, if it specifically talks about that, about the interconnectivity of the defendants and their role together in bringing this character to market.”
