“Many AI Patent Eligibility Issues Still Hazy After Guidance” (featured quotes)

In an article published on July 17, 2024, Marshall Gerstein Partner Cameron Pick was quoted in Law360 discussing the new United States Patent and Trademark Office (USPTO) guidance on patent eligibility for inventions involving artificial intelligence (AI). The guidance comes after an executive order in October 2023 calling for the office to develop guidelines on patent eligibility issues related to AI.

Pick told Law360 that the examples that the USPTO provided in its guidance are helpful, but they fail to account for many of the ways that AI is being implemented. Cameron illustrates the need for further clarity when it comes to patent-eligibility of AI technology and explains why he believes that the analysis “falls short a little bit” when it comes to making the U.S. a leader in the field.
