David A. Gass and an international panel of patent professionals will discuss challenges for securing IP protection for biomarker diagnostics. Panelists will discuss:

  • How the Supreme Court's decision on "business method patents" in Bilski v. Kappos impacts biomarker diagnostics
  • Important cases before the Federal Circuit, such as Myriad (patent eligibility of "genes" and diagnostic methods), Prometheus and Classen (patent eligibility of diagnostic inventions with a treatment component)
  • Territoriality and joint infringement considerations
  • Perspectives on these issues before the US PTO and EPO

Biotech Patenting and Tech Transfer Track - Innovative Collaborations: Successful Deal Structures for Non-Profit/For-Profit Collaborations, June 30, 2011 at 8:30 a.m. in Room 151A

Pamela L. Cox will be joined by representatives of senior leadership at The Procter & Gamble Company, Novozymes, Mayo Clinic and Cambridge Enterprise at the University of Cambridge who will share their insights on what deal structures support successful industry collaboration with non-profits. The panel will:

  • Provide examples of productive collaborations and discuss the elements of those deals that contributed to their success
  • Cover agreement terms that might be used to implement those elements in your collaborations
  • Reflect on a few cautionary tales of failed collaborations, the warning signs and how to structure and draft your collaboration for a better outcome
