November 20, 2025Marshall Gerstein Partner and IP Litigation Chair Ben Horton was interviewed by Law360 for his perspective on the significant verdict in a federal jury trial involving Apple and Masimo. In a years-long dispute between the two companies over smartwatch patents, a jury handed Apple a $634 million infringement verdict, and the U.S. International Trade Commission will weigh in on whether its redesigned products infringe on Masimo’s patents.
Ben told Law360 that he’s looking forward to seeing claim construction agreements on appeal, including those over the term “patient monitor.” Ben said in an interview, “It feels like that will be a pretty hotly contested issue because it could vacate the entire award.”
Over Apple’s defense, Ben told Law360, “Apple probably believes [something like]: ‘Your patent is not innovation. We innovate. We create things. You don’t create anything. And so we’re not giving you a dime.’”
