Topics to be discussed include:
- “Lessons from Recent Patent Cases” – We will discuss recent case law involving willful patent infringement/enhanced damages, opinions of counsel, patent exhaustion, the on-sale bar, ownership/chain of title issues as well as lessons/potential mistakes to avoid.
- “Protecting Your Innovation in Today’s High Tech Environment” – Protection for new technologies through both patents and trade secrets, including protecting software related technologies in a post-Alice environment will be discussed.
- “Mistakes to Avoid in IP Transactions” – Mistakes to avoid in a variety of IP transactions, including pitfalls associated with key provisions in such agreements will be discussed.
This session is approved for CLE credit by the state of North Carolina.
Joshua Elliott, partner, focuses on patent law matters related to biochemistry and biotechnology, including advising and counseling clients on issues such as freedom-to-operate, infringement, validity, and design around strategies. His practice includes rendering opinions, conducting patent due diligence investigations, advising clients on patent portfolio strategies, strategically managing global patent portfolios, and preparing and prosecuting patent applications. Mr. Elliott also has experience advising clients on due diligence issues related to potential investments, venture funding, and initial public offerings.
Randall Rueth, partner and chair of Electrical & Computer Technologies practice group, advises a wide range of clients innovating in electronics, software products and processes, e-commerce, and the insurance and financial services industries. Mr. Rueth advances and protects the value of clients’ technologies through skillful prosecution work, insightful analysis and opinions, as well as strategic counseling.
Julie Watson, special counsel and member of Marshall Gerstein’s IP Transactions practice group, concentrates on counseling related to intellectual property transactions with a particular emphasis in technology startups and university technology transfer. A licensing professional with over 25 years of experience structuring complex intellectual property transactions in-house, Ms. Watson has a deep appreciation of client needs and knows how to deliver strategic solutions.
