“Coming to Terms: Attorneys See Agreements with AI Tech Companies as a Natural Progression”

Marshall Gerstein partners Tiffany Gehrke and Ryan Phelan provided their insights in a Chicago Lawyer story on the intersection of AI technology and intellectual property. A key component of implementing AI technologies in a business is around education, notes Tiffany, who leads training sessions for companies to help them stay on top of the intricacies of social media and marketing platforms. “It’s a lot around education and awareness to even just flag something (and ask) ‘should I be worried about this?’” she told Chicago Lawyer in an interview. “Or should I run this by someone to find out if I can use this type of tool?”

Ryan pointed to the USPTO’s guidance on AI that was issued this summer but says that clarity is still needed. “It seems like the USPTO would benefit greatly from an AI case that percolated up to the Supreme Court,” he said. “Or if Congress clarifies some issues with respect to 35 U.S.C. Section 101, which deals with eligibility.”
