Thomas L. Duston (Litigation – Intellectual Property)

Mr. Duston, an experienced hands-on trial lawyer, has litigated patent infringement claims representing clients in a diverse array of technologies within the medical, pharmaceutical, semiconductor, computer, Internet, explosives, automotive and metals industries, among others. He has been lead counsel in more than 60 patent infringement matters in federal courts throughout the United States. Most recently, Mr. Duston served as lead trial counsel for one of the defendants in Eolas Technologies LLC v. Adobe, et al. (E.D. Tex.), a case in which defendants successfully invalidated two of the most notorious early Internet patents. Mr. Duston’s talents also include strategically positioning cases so as to enable favorable dispositions through negotiation, dispositive motions, or parallel reexamination proceedings. Mr. Duston has represented some of the most sophisticated companies in the U.S. including CDW, Charter Communications, T-Mobile, Groupon, Express LLC, Home Depot, GE Aviation, Abbott Laboratories, Raytheon, as well as Zappos.com, among others.

Anthony S. Gabrielson (Litigation – Intellectual Property)

Mr. Gabrielson has extensive experience in all phases of intellectual property litigation and has consistently demonstrated his ability to skillfully protect clients' business and legal interests in patent infringement matters involving technologies spanning computer software and hardware, e-commerce and web interfaces, fiber optic video networks, agricultural equipment, and medical and consumer products, among others. He has counseled some of the nation’s largest companies, has served as lead trial counsel on numerous federal and state court litigation matters, and also advises on the ever-developing areas of eDiscovery and management of electronically stored information. In addition to being twice-voted an Illinois Super Lawyer, Mr. Gabrielson was selected as Law Bulletin Publishing Company’s "40 Illinois Attorneys Under 40 to Watch" and was the exclusive winner in the International Law Office (ILO) Client Choice Awards 2014 "Intellectual Property Patents – Illinois" category.

Robert M. Gerstein (Patent Law)

Mr. Gerstein, a member of the Firm's Executive Committee, has more than 25 years of experience counseling clients in a wide range of industries on all aspects of intellectual property, negotiating patent and trademark agreements and providing legal opinions. He currently focuses on a variety of IP transactions, but has a long history in patent litigation, where he has been involved in the settlement of over one hundred matters. Whether in litigation or transactional matters, he strives to provide practical and economical solutions, tailored to the specific matter and each client’s business. Mr. Gerstein was selected as one of the "World’s Leading Intellectual Property Strategists" and also as one of the "World’s Leading Patent Practitioners" by Intellectual Asset Management magazine. Mr. Gerstein is listed in the Martindale-Hubbell® 2009 Bar Register of Preeminent Lawyers and was also awarded its AV Peer Review Rating™.
