In October’s Policy issue of Biorefining Magazine, Paul C. Craane discusses the USPTO’s significant new responsibilities under the America Invents Act. As Mr. Craane explains in "Patents in Transition," the USPTO will have to deal with changes made to fundamental patent law concepts, changes that will be implemented over a protracted transitional period. In addition, the USPTO will have an expanded role in adjudicating validity challenges. Mr. Craane suggests that the added workload may cause conflict between the USPTO and Congress over adequate access to user fees. With successful implementation hanging in the balance, the AIA’s passage may be just the beginning of the story.
Paul C. Craane is a partner in the Cleantech and Renewables Group at Marshall Gerstein & Borun LLP. For nearly twenty years, Paul has prosecuted patent applications and reexaminations at the USPTO, and litigated patent cases in various US courts.
