Paul C. Craane Advises Caution on USPTO Examiner Guidelines

In the wake of the eagerly-awaited Supreme Court decision, the United States Patent and Trademark Office issued interim guidelines to its examiners on how to apply Bilski during examination. Paul C. Craane suggests that the guidelines provide unclear, or perhaps even incorrect, guidance as to how to reject a claim under 35 U.S.C. 101. Mr. Craane’s comments appeared in the Patently-O Blog on July 22, 2010, as well as in the LexisNexis Patent Law Community Blog and in IPFrontline.com on July 2, 2010.
